Taiwan's government recently announced that it will soon amend existing laws governing cross-strait exchanges to impose a maximum three-year sentence and a maximum possible fine of NT$15 million (US$540,005) on Taiwanese proxies of Chinese companies who facilitate Chinese investment in Taiwan without government permission.

Despite its historic achievement, the Taiwanese same-sex marriage law passed in 2019 did not provide full legal equality. One glaring omission is the right of all transnational same-sex couples to lawfully marry.

We are the Taiwan Alliance to Promote Civil Partnership Rights (TAPCPR) and, as the leading legal aid organization for LGBTI rights in Taiwan, started raising awareness and campaigning for the rights of transnational same-sex couples back in 2017. We also represented several clients to initiate relevant litigation in 2019.

Same-sex couples in which one partner is Taiwanese and the other is a foreign national of a country that does not yet recognize same-sex marriage are not permitted to marry, as per Article 46 of Taiwan’s “Act Governing the Choice of Law in Civil Matters Involving Foreign Elements” which is currently interpreted as prohibiting such marriages in Taiwan. We believe that this interpretation is illegal and unjust, and transnational same-sex couples have finally won two court cases this year! Nevertheless, the government still refuses to promptly modify its interpretation or to amend relevant laws and regulations. The Judicial Yuan has prepared a draft amendment of Article 46 of Taiwan’s “Act Governing the Choice of Law in Civil Matters Involving Foreign Elements” and sent it to the cabinet (Executive Yuan) back in January 2021, but the cabinet has not yet sent the bill to the Legislative Yuan (our parliament).

The threat of COVID-19 has made the situation of transnational same-sex partners even more precarious than usual. We need more people to stand with us in this fight for true marriage equality!

The Taiwan Alliance to Promote Civil Partnership Rights ("TAPCPR") was founded in 2009, and registered with the Ministry of the Interior in August 2012. We drafted three bills for “diverse family formation” in 2012, which laid the foundation for future legislation. In 2017, we represented Chi Chia-Wei and won the same-sex marriage case (“Judicial Yuan Interpretation No. 748”), making Taiwan the first country in Asia to legalize same-sex marriage in May 2019.

美國跟國際社會持續關心金門、馬祖，台灣有部分言論說美國的《台灣關係法》不適用金馬地區，是錯誤觀念，《台灣關係法》是適用「台灣治理當局」所有實質治理地區。

《台灣關係法》第15條，除了正面表列台灣跟澎湖之外，未正面表列蘭嶼、綠島等其他島嶼。但是，法條內也提到《台灣關係法》適用對象是「台灣治理當局」（governing authorities on Taiwan）以及「台灣治理當局」的「政治分支機構」跟其他「機構」（political subdivisions, agencies）。金門縣政府跟連江縣政府，當然是「台灣治理當局」的分支機構。

美國對「台灣治理當局」的想法，在《台灣關係法》就有寫，是1979年前美國承認為「中華民國政府」的政府。所以《台灣關係法》適用「台灣治理當局」所有實質治理地區，並未刻意排除金馬。

要注意的是，《台灣關係法》並非防禦條約，並非用領土概念在進行思考，而是美國跟台灣政府進行規範跟互動的法律，並界定美國政府跟台灣各級政府、美國政府跟台灣人民的關係。

金門與馬祖地區從1955至1979年代都有美國駐軍，金馬地區到現在，美國仍持續關注，包括美國在台協會（AIT）前處長酈英傑（Brent Christensen）於2020年赴金門追思八二三砲戰，AIT前發言人孟雨荷（Amanda Mansour）2021年前往馬祖，參觀過去的軍事設施，還在昔日軍事坑道裡面高歌「Stand by me」（與我站在一起），並到馬祖高中與青年學子演講交流。

另外加拿大駐台代表芮喬丹（Jordan Reeves）三月也造訪馬祖，登上台灣海巡署的船艦，這顯示美國與國際社會持續關心金馬。

Sant’Agata Bolognese, 30 April 2020 – Automobili Lamborghini is set to resume its production activities from 4 May, in accordance with the Italian Prime Minister’s decree of 26 April. The Sant-Agata Bolognese company is currently completing all preparatory measures to ensure its people return to work in conditions of maximum safety.

While company activities were temporarily suspended, Lamborghini repurposed some of its departments to produce medical protection masks and visors for St. Orsola Hospital in Bologna, and established a partnership with SIARE Engineering International Group for co-engineering and manufacturing breathing simulators.

The preparation for the 4 May reopening has been the subject of ongoing discussion and definition within the Joint Committee of the Company and Trade Unions on the COVID-19 emergency, set up in the wake of the temporary suspension of company activities on March 13. Over the last weeks, the parties have worked together on a precise safety protocol governing the procedures for returning to work and the equipment to be used in order to ensure the maximum safety of Lamborghini’s workforce, starting with a comprehensive educational campaign.

Stefano Domenicali, Chairman and CEO of Automobili Lamborghini, commented: ”We are ready to restart with great energy, but also with strict protocols for safeguarding what is most precious to us: the safety of our people. This priority is why we were the first Italian automotive company to close and continues to be our guiding principle for a well-reasoned and safe recovery, because we still have not won the battle against COVID-19.
