我來說說對這題的看法。

以下說明差不多是把我上課說的話寫下來，因此很長。

【題目】(原文太長了，下面會列出所需要的部分，其餘請自查找。)

The author's position regarding the intent of the framers of
the Fourteenth Amendment would be most seriously undermined
if which of the following were true?

(A) The framers had anticipated state action limitations as
they are described in the passage.
(B) The framers had merely sought to prevent discriminatory
acts by federal officials.
(C) The framers were concerned that the Civil Rights Act of
1866 would be overturned by the Supreme Court.
(D) The framers were aware that the phrase "equal
protection of the laws" had broad implications.
(E) The framers believed that racial as well as non-racial
forms of discrimination were unacceptable.

本題問「本文作者對於第十四修正案制訂者意圖的看法」在何種情況
下會被推翻。

【定位】

對於此「意圖」定位，不在第一段。因為第一段說

Although precisely what the framers of the amendment meant
by this equal protection clause remains unclear, all
interpreters agree that the framers' immediate objective was
to provide a constitutional warrant for the Civil Rights Act
of 1866, which...然後就寫了一大堆此修正案制訂的背景。

此處說 what... meant... remains unclear，指出了「意涵」不明
。不過所有 interpreters 對於短期目標 immediate objective 卻
沒有爭議。

在第一段我們看不到作者的對於此修正案 intent 的看法。

【正確定位】

作者的看法在第二段第一句：

The broad language of the amendment strongly suggests that
its framers were proposing to write into the Constitution
not a laundry list of specific civil rights but a principle
of equal citizenship that forbids organized society from
treating any individual as a member of an inferior class.

【大意】從修正案所使用文字的廣泛與概括 (broad language) 可以
看出，制訂者加入憲法裡的，不是某些特定公民權利的細目清單，而
是平等民權的原則性宣示，要求任何有組織的團體，都不能用對待次
等階級的成員的態度來對待任何個人。

在這裡動詞用 strongly suggests，明白看出這是作者的看法 (the
author's posistion)。

在第二段的接下來兩句裡：

Yet for the first eight decades of the amendment's
existence, the Supreme Court's interpretation of the
amendment betrayed this ideal of equality.

In the Civil Rights Cases of 1883, for example, the Court
invented the "state action" limitation, which asserts that
"private" decisions by owners of public accommodations and
other commercial businesses to segregate their facilities
are insulated from the reach of the Fourteenth Amendment's
guarantee of equal protection under the law.

作者指出，最高法院在其後的八十年裡，卻曲解憲法、自創主張，提
出除外規定，因而違反了第十四修正案原本的平權保護觀念
(betrayed this ideal of equality)。並舉了例子加以說明。

因此本題中author's position 就清楚了。

【解題】

接下來要看，在什麼情況下，可以對此 position 加以推翻。此處僅
就有問題的(A)(B)加以說明：

(A) The framers had anticipated state action limitations as
they are described in the passage.

【大意】修正案制訂者已經預想到，將來會有如文章中所述的 state
action limitation 的情況了。

如果制訂者預先就想到最高法院後來會搞個 limitation 出來，因此
在憲法條文裡就用原則性宣示，排除任何因為清單條列方式所可能產
生的掛一漏萬，那不就代表制訂者思慮周密，防範於未然嗎？這樣說
來，作者對於制訂者意圖的看法，就沒有錯了。

因此 (A) 不是答案。

【正確答案】

至於答案

(B) The framers had merely sought to prevent discriminatory
acts by federal officials.

【大意】修正案制訂者僅僅只是想要 (merely sought to) 防止聯邦
官員的歧視行為。

若這真的是制訂者當初的「意圖」 (intent)，那麼剛剛第二段第一
句作者說，制訂者想做的是「無所不包的原則性宣示」的看法，就與
制訂者的想法相反了。因此這樣的達到了推翻作者的看法。

因此答案是 (B)。

【吳中東解答疑問處】

依我的看法，吳中東對這題的解法，主要是錯在定位。他用到第一段
前半與第二段後半，卻獨漏了第二段第一句。這個錯誤應該是嚴重的
疏忽。

第二，吳中東將答案 (A) 的理解為：

「(A) 指出如果第十四條修正案制定者當時就已經具有 (had
anticipated) 文章所述的 (described) 後來最高法院炮製的政府行
為有限論的觀點 (state action limitation) 的話」

這個翻譯是錯的。原文意思應該是

「預想到……會發生」

而非

「具有……的看法」。

因而吳中東錯把 (A) 當成了正確答案了。

最後要說，吳中東書上對於本題的說明，還有其他的錯誤。看的時候
請小心。
