【山城士多就 Ztore 創辦人言論之回應】

早前 士多 Ztore 創辦人之一凌俊傑 (Clarence Ling) 在 Facebook 發表支持《逃犯條例》修訂案的言論，除了在社會上引起很大的反響，亦令我們山城士多一眾現任及創辦成員為之側目。雖然事隔一星期，我們還是不得不作出回應。
　
山城士多於 2015 年 9 月由一班中文大學的同學創辦，開初是為了抗衡中文大學內百佳超級市場的壟斷。我們一直致力推廣本地製造的產品，拉近消費者與生產者的距離，鼓勵良心消費。成立一段時間後，我們喜見支持香港製造的風潮在社會漸漸流行，有關店舖更有如雨後春筍般冒起。作為其中一員，Ztore 將支持香港製造理念商業化，使更多市民可購買本地產品。正因理念一致，我們慢慢開始與 Ztore 合作，讓中大同學透過我們的平台，訂購部分 Ztore 代理的本地產品，而我們亦有提供部分本地社企的產品予 Ztore。一直以來，我們都合作愉快。
　
可是，Ztore 創辦人之一凌俊傑近日公開發表支持《逃犯條例》修訂案的言論，對充滿理想的示威者冷嘲熱諷，實在令人髮指。其言論亦不禁令人懷疑 Ztore 創立真是為推廣香港製造的理念，抑或只是打著香港製造的旗號謀利。
　
香港正處於存亡危急之秋。《逃犯條例》修訂案通過定必扼殺香港的未來，更枉論對香港製造行業的深遠影響。一直以來，香港極優良的營商環境都有賴公正、健全的法治制度所保護。《逃犯條例》修訂案通過後將為本港的司法制度打開缺口，使在香港生活及工作的本地和外國人處於被引渡到中國接受不公平審訊的恐懼。此舉將大大打擊外資在港營商的信心。如各大公司撒資，將使本港經濟衰退。
　
儘管 Ztore 在推廣香港產品曾有所貢獻，我們亦不能接受自己付出的金錢會讓這樣一個人得益。雖然我們微不足道，但我們深信，每一次付款都是一種投票；而我們堅決不會投給 Ztore。
　
在此，山城士多鄭重宣布，即時終止與 Ztore 的所有合作及來往。
　
山城士多上下都十分關注近來的抗爭運動。我們對政府仍未回應廣大市民的五大訴求深表遺憾，並強烈譴責警隊使用過分武力鎮壓示威，令眾多香港市民受傷。我們促請政府立即撤回《逃犯條例》修訂案、收回 6 月 12 日示威「暴動」的定性、釋放被補示威者並撤銷他們所有控罪及追究警隊濫用暴力。有關官員亦應立即引咎辭職。
　
山城士多未來會繼續發展，將我們的理念普及大眾，給各位一個真正的良心選擇。

[A statement by CUStore on the comments by Ztore’s founder]
　
Ztore’s founder Clarence Ling has recently voiced out his support of the proposed amendment bill to the Fugitive Offenders Ordinance. His comments not only sparked huge controversy in society but also staggered current and founding members of CUStore. Although it has already been a week since Clarence Ling’s comments were posted, we still feel the urge to make a reply.
　
CUStore was founded by a group of CUHK students in September 2015 with the hope to break the monopoly of the Parknshop supermarket on our campus. We have been tirelessly working to promote Hong Kong made products and the idea of ethical shopping by drawing consumers closer to the producers. After our foundation, we were delighted that the idea of supporting local products started to become fashionable and that shops selling local products appeared in large numbers. As one of the members in the raising trend, Zstore commercialised the idea of ‘Made in Hong Kong’ so that more people can buy local products easily. Because we had similar aspirations, we started to collaborate with Ztore. We sold some of Ztore’s local products to CUHK students on our platform and provided products from local social enterprises to Ztore. The collaboration was going well.
　
However, just last week, Ztore’s founder Clarence Ling publicly stated his support to the amendment bill and sneered at the protesters who were full of ideals. His detestable comments made one wonder if his business was really supporting ‘Made in Hong Kong’ or if they were just using the idea solely to make money.
　
Hong Kong is at a most critical point at the moment. If the amendment bill is passed, the future of Hong Kong will be wrecked. There will be profound effects on the local manufacturing industry. Hong Kong’s excellent business environment has always been safeguarded by the just and sound legal system. The bill will create a fault in our legal system and put local and foreign people living and working in Hong Kong under the fear of being extradited to China where there is non-existence of a fair trial. Foreign companies will have much less confidence to do business in Hong Kong. When capitals leave Hong Kong it will inevitably lead to an economic recession.
　
Although Ztore has contributed to the promotion of local products, we still cannot accept that the money we pay will fall into such kind of a person like Clarence Ling. We may be insignificant; but we strongly believe that we are casting a vote whenever we pay — and we definitely are not voting for Ztore.
　
For that reason we hereby announce that we are terminating all the collaboration and ties with Ztore.
　
All of us from CUStore are very concerned about the recent protests going on in the city. We deeply regret that the government has failed to respond to the demands made by the Hong Kong citizens. We also strongly condemn the use of excessive violence by the Hong Kong Police Force during the protest on 12 June, which left many of our citizens injured. We urge the government to scrap the bill immediately, retract the use of ‘rioting’ in describing the protest on 12 June, release the arrested protesters and remove the charges against them, and investigate on the use of excessive violence by the Hong Kong Police Force. Those relevant government officials should take their responsibilities and resign immediately.
　
In the future, CUStore will continue to evolve and spread our ideas to the public.

民間土地資源小組今早舉行記者會，發布及簡述遞交予政府土地供應小組的意見書。

民間小組認為香港並非沒有足夠土地，香港需要長遠及具策略性的規劃視野，並改善現有的規劃過程和土地供應階梯。政府正無視現有可作發展的土地。

此外，政府和專責小組在諮詢內只集中在選擇1200公頃土地供應，並沒考慮連帶的土地分配和實行問題。

民間小組再次重申堅決反對東大嶼人工島計劃（造價昂貴）和發展郊野公園（特別資產）。

Citizens Task Force on Land Resources (CTF) published its position paper submitted to the public consultation by the Government's Task Force on Land Supply.

“There is no land shortage. What we need is a better, strategic land use planning. We don't need a new land reserve, we need to improve our planning process and fix our land supply pipe line. Government is ignoring obvious land supply options.”

"Government and its taskforce focus is only on supply, without considering improvements to be made to implementation and distribution of land use."

CTF reinstated its objections to development of Country Parks (a special asset to be safeguarded) and the East Lantau Metropolis (expensive and will divert resources from fixing the NT)

【百戰沙場碎鐵衣 獨領殘兵千騎歸】— 大專學界就港共政權清算抗爭者告全港市民書

香港市民：

二零一六年農曆新年，政府一改慣例，將小販趕盡殺絕。港人因而聲援旺角新年小販，支持本土文化。豈料警方突然暴力清場，更向天鳴槍，終引發大規模警民衝突。港共政權以暴動罪起訴抗爭者，清算異己。過去兩年已陸續有抗爭者因暴動罪被判刑，抗爭者為爭取公義卻失去了數以年計的光陰，大專學界對抗爭者的遭遇表示痛心，並譴責港共政府無恥之舉。

昨天盧建民和梁天琦竟被分別判囚七年和六年，日前亦有抗爭者被判以數年計的監禁。大專學界認為近日判刑過為苛刻。香港法例早已變得因陋守舊。《公安條例》對暴動罪中「破壞社會安寧」並無清晰界定，而「非法集會」和「暴動」的定義亦無明確分野，兩者卻存在差天共地的量刑標準，讓法例淪為政權打壓抗爭者的工具。聯合國亦曾兩度批評現時《公安條例》並未能為市民集會自由提供足夠保障，唯香港仍然固步自封，迴避檢討《公安條例》。學界促請檢討現行法例，確保港人權利在維持社會秩序中亦有所保障。學界亦認為裁決和量刑考慮中，社會現況和抗爭者的動機意圖都是不可忽視的公共政策因素。若被告行動的意圖或動機是真誠追求社會利益而非個人利益，法律亦應予以考慮。

今天抗爭者身陷囹圄，我們更要去食存信，把抗爭者為我城鞠躬盡瘁的精神銘諸心腑。在當今專制政權之下，大專學界誓必與港人同行，以追求自由為志，銘記同儕犧牲，思考我城前路。佛朗士在《諸神渴了》中寫道：「當政府違反人民權利時，反抗乃為人民責任中最神聖、最不可缺少的。」赤化風暴從未止息，我城前路憂堪：一地兩檢、國歌法本地立法和廿三條立法等危機接踵而來。此刻我們決不可如槁木死灰，更不可視若無睹。作為香港人，我們不能把拯救我城的責任假手於人，也不應對我城未來失去希望。希望愈渺茫，我們愈要捉緊；唯有堅持，我們才有機會把握我城命運。

A Lost Battle Is A Battle One Thinks One Has Lost - A Letter to All Citizens of Hong Kong from Students’ Unions of Higher Institutions

Dear Hong Kong Citizens,

During the Lunar New Year of 2016, the government changed its usual practice and forbidden the hawkers to make their own living ruthlessly. Thus, in order to defend the local culture, Hong Kong people stood up and supported the hawkers in Mong Kok. Yet, the police suddenly arrived at the scene and evicted the protesters in violence. Worst still, they even fired bullets amidst the crowd. The clampdown eventually led to a large-scale conflict between police and protesters. In the past two years, there have been protesters prosecuted by the government and sent to prison for crimes such as riots. The Students’ Unions of Higher Education Institutions in Hong Kong would like to express our utter sadness towards the hardship suffered by the convicted and accused protesters in the Mong Kok Cases. Moreover, we hereby condemn the shameful act of the regime.

Apart from the seven-year and six-year imprisonments suffered by Lo Kin-man and Edward Leung, several protesters have also been sent to jail for years. The Students’ Union of Higher Education Institutions in Hong Kong would like to express our concern and discontent towards the oppressive and unreasonable sentences recently. In fact, the laws in Hong Kong have already become obsolete. In "Public Security Ordinance”, the meaning of "leading to a breach of the peace" is not clearly defined. Moreover, there is no clear distinction between the definitions of “Unlawful assembly" and "Riot”, but the criterions for imposing penalty are completely different for these two crimes. Such loopholes allow the regime to use laws as means to suppress the protesters. The United Nations has twice criticised that the current “Public Security Ordinance” does not provide citizens with sufficient protection to enjoy their freedom of assembly. However, the Hong Kong government evades reviewing the current "Public Security Ordinance”. We then urge for a review of the current laws to ensure that the rights of Hong Kong people are safeguarded while maintaining social order. We also believe that the current situation in the society, as well as the intention of the protesters, are public policy factors that cannot be ignored. Such intention should also be considered If the defendant strives to pursue social interests instead of self interests.

Today, protesters were imprisoned as they were prosecuted by the regime. We shall keep our faith despite the adversities, engraving the protesters’ spirit of sacrificing themselves for our city on our mind. Under the dictatorial regime, the Students’ Union of Higher Education Institutions in Hong Kong pledge to walk along with all citizens throughout the journey of pursuing freedom. We shall bear in mind the sacrifices of the predecessors and ponder over the future of our city. In “The Gods Are Athirst”, Anatole France wrote: “When the Government violates the Rights of the people, insurrection is for the people the most sacred and the most indispensable of duties.” Hong Kong has never escaped from the increasing control of the communist party, and its future is disconcerting as human rights and rule of law are being devastated. When various crises such as the co-location arrangement together with legislations of national anthem law and Article 23 come around incessantly, we shall never let our voice die down nor allow the regime to trample on us. It is only the Hong Kong people who bear the responsibility of saving our city. We shall never lose hope of the future of Hong Kong, as only through perseverance and assertiveness can we take control of the destiny of our home.

Jean-Paul Sartre once said, “a lost battle is a battle one thinks one has lost.” Shall we fight and struggle with persistence, Justice will return gloriously.
