2019 年的今天，《司法院釋字第七四八號解釋施行法》施行，同性婚姻在台灣正式合法化。

然而，一年後的今天，我們回頭看，這條路卻是充滿挫敗。

🏳️‍🌈1986

1986 年，祁家威在一家麥當勞召開開國際記者會，公開出櫃同志身份，是台灣第一個出櫃的同志。

🏳️‍🌈2003

2003 年，台灣舉辦正式的第一屆同志遊行，路線從著名男同性戀聚集地——228 和平紀念公園，經過紅樓劇場，約 2,000 人參與，當時的台北市長馬英九在遊行結束後，上台致詞。

🏳️‍🌈2006

2006 年，蕭美琴、余政道、林淑芬、鄭運鵬等民進黨籍立法委員，提出《同性婚姻法》草案，在黨內同志連署下，跨足門檻。但在一讀宣讀後，在委員會遭到賴士葆等 21 名國民黨 籍立法委員阻擋，最後法案胎死腹中。

🏳️‍🌈2013

2013 年尤美女、鄭麗君、蕭美琴、林淑芬、段宜康、陳其邁等 22 位民進黨籍立法委員，提出台灣伴侶權益推動聯盟版本的《民法》修正案，隔年進行審議。

但在當時馬英九政府的法務部、國民黨籍立法委員的反對下，未有結論。

直到 2016 年，國會改選後才終於完成一讀。

2017 年 5 月 24 日，司法院公布釋字第 748 號解釋，大法官在解釋中明確表示，同性和異性沒有不同，現況下民法沒有保障同性婚姻，違反憲法所保障的平等權以及婚姻自由，因此違憲。

另外，大法官表示，2019 年 5 月 24 日以前一定要完成法律的制定，至於要用專法或是修民法，大法官採開放態度。

2018 年 11 月 24 日，反同方所提的三項公投通過，支持方兩項沒有通過，確定不更動《民法》條文，只能制定一部符合釋字 748 號解釋所建構的「專法」。

（再次提醒，大法官解釋大於公投，公投改變的是「法律位階」，大法官解釋大於法律。）

2019 年 5 月 17 日，國際不再恐同日，2016 年台灣經歷第一次的立法院政黨輪替，民進黨雖然受到選區反同方極大的壓力以下，仍和時代力量聯手將《司法院大法官釋字 748 號解釋施行法》通過，台灣，成為亞洲第一個同性婚姻合法化的國家。

2003 年，美國麻塞諸塞州最高法院在 Goodridge .v Department of Public Health 案判決，相關法律禁止同性婚姻，違反麻州憲法，宣告違憲。

麻州最高法院引用了美國聯邦最高法院的名言：

「雖然法律難以改變人們的偏見，但是法律不可以為偏見服務，更不可以使人們的偏見因法律直接或間接地產生力量。」

“The Constitution cannot control such prejudices but neither can it tolerate them. Private biases may be outside the reach of the law, but the law cannot, directly or indirectly, give them effect.”

回到台灣，雖然專法不完美，用民法仍然是最好的答案。

但不論如何，從祁家威先生出櫃那天，點燃了台灣對於同志議題的討論以及三十餘年的運動之後，我們成了亞洲第一個實施同性婚姻的國家，而且過了一年，大家還是一樣好好的。

專法施行週年並不是終點。不論在哪一個位置，守護台灣，是我們的責任。
