陪審團制度目前大多只是在美國。
小陪審團--負責定事
美國憲法第6條修正案規定，被告有權與指控他或她的證人對質，並有權為獲得能為他或她辯護的證人而得到幫助。在所有的聯邦刑事案件及多數州民事案件中，被告會堅持由陪審團對這種正面對質做出裁決。最高法院於1968年做出解釋，說明陪審團制度適用於州的主要刑事案件。在聯邦體系中，小型的或審判用的陪審團由12人組成。州法院可以是6人，而且最高法院已規定──與州陪審團不同──如果州法律有規定；州刑事案陪審團可以根據「多數陪審員」的意見做出判決，而不必要一致同意。
大陪審團--負責起訴
第二種陪審團是大陪審團，可以是一個起訴或調查團體，可以少至1人或者多至33人。按照憲法第5條修正案的規定，所有受到聯邦指控的死罪或其他「重罪」(刑期在1年以上)都必須首先由大陪審團起訴。其他的聯邦指控及各州的犯罪都是提交到法院，陳述情況，由法院做出抉擇，從法官那裡得到對刑事案件提出指控的可能性的裁決。約半數的州有大陪審團，多數從事調查各類公眾問題或政府官員的行為，而不承擔指控。他們可以提交用於指控某些具體人的報告，而並不實際起訴他們。
歷史發展
陪審團作為一種制度在英國歷史上可追溯到數百年以前。在大約1172年左右。亨利二世統治時期，它成為普通法體系的一部分，後於1215年被大憲法所承認。從那時起，建立了12人的標準，形成了地位相等的人組成陪審團的概念，產生了由大陪審團起訴的做法。從本質上講，陪審團是允許公眾進入司法程式的一項措施。州對某人的審判權透過一個由市民組成的小組體現出來，這個小組決定被告的命運。起初，這一程式的存在僅僅是為了排除國王和貴族對審判權的控制，今天我們將地位相同的人組成陪審團」(憲法中並沒有提及，只是提到公正的陪審團)解釋為至少部分是在社
會和經濟方面同被告有相同或相似背景的人組成的陪審團。大陪審團和小陪審團的成員一般都是從當地選舉人名單上選出來的。某些職業，如醫生、律師、牧師、教師、護士、員警通常不讓擔當陪審團成員。在一些州，家庭主婦或任何婦女可以要求退出。辯方及起訴檢察官都有權不說明理由而免除一定數目的陪審員資格，也可以以偏見為由免去其他陪審員。這樣做的結果是，陪審團幾乎從未代表人口組成情況，或是與被告地位相同的集團。
今天，無論是大陪審團還是小陪審團，都受到了抨擊。陪審團審判的方式正日漸消亡。許多人聲稱只有消除陪審團審判才會有公正的審判。對陪審團行為的研究表明，陪審團成員一般都被法官所左右，並且都強烈地傾向於相信被告可能有罪。大陪審團也在考察之列。977年美國律師協會(American Bar Association)提出了一套改革方案，要求保護被大陪
審團起訴的被告，包括賦予其律師辯護權，以及嚴格規定對拒不回答問題的被告的關押期
限。這些改革方案尚未由國會通過，但已在某些州逐漸地執行了。另一些州在實際上已經
解散了大陪審團。
