在世人尚不知曉COVID-19的存在時，中國武漢醫生李文亮在社群媒體發佈疫情信息，遭到警方傳喚、訓誡。李文亮被視為最早的吹哨人之一，他後來被確診，並於2020年2月6日病逝，引發民間劇烈反應。他的微博變成中國「哭墻」，每日，成千上萬的網友湧入留言區，傾訴對他的思念和哀悼、也分享自己的生活和感想。
這一留言區一度遭到清除和禁言，後在巨大的質疑聲浪中恢復。端傳媒整理了2月1日（他最後一條微博發佈日）到4月17日的732370條一級留言，並精選出其中部分留言，製成本展品，獻給所有「吹哨人」和聽到哨聲的人們。

Description
On December 30th, 2019, before the world was aware of the threat of COVID-19, a Chinese doctor Li Wenliang issued the first warning about the deadly coronavirus and then received a letter of admonition from the police. Li Wenliang was recognized as one of the earliest “Whistleblowers” of COVID-19’s spread in China. In early February, Li Wenliang was diagnosed with COVID-19 and passed away within a week. His death drew a lot of attention. After the news spread, his Weibo account was instantly flooded with millions of comments, mourns, or simply greetings or reflections from Chinese netizens everyday, known as a “Chinese Wailing Wall”. Those messages had once been deleted and commenting under his Weibo account was forbidden; however, after a huge wave of criticism, the wailing wall was restored. Initium Media sorted out the 732,370 main messages from February 1st, the date he posted the last Weibo, to April 17th and recreated a digital version of selected messages. The NFT is devoted to every “Whistleblower” and those who heard the whistle.

１、 被告曾有過酒駕犯法的紀錄 且

#加州酒駕刑事罰則整理與簡介
一、加州法上所謂的謀殺所指為何？
1、謀殺是致死犯罪(homicide)的一種，也是最嚴重的一種。謀殺與一般致死最大的差異在主觀的惡意與預謀。
２、依據加州刑法（ California Penal Code Section 187 PC）需要有故意致人於死的主觀要件（specifically intentional killing of another）
被告必須具備：
（１） 惡意 malice
（２） 致死而無阻卻違法事由killed without a lawful excuse or justification.
（３）惡意包括明示/外顯 的惡意以及 潛在/隱藏 的惡意Malice can either be express or implied.
而所謂的潛在/隱藏的惡意 由下列事項可以推知證明：
Ａ The defendant committed an act
Ｂ The natural consequences of this act were dangerous to human life
Ｃ At the time the defendant acted, he or she knew the act was dangerous to human life
D The defendant consciously disregarded the threat to human life and acted anyways
二、為何酒駕致人於死可能構成二級謀殺？
酒駕致死發生時，檢察官可以選擇一般酒駕致死罪起訴或二級謀殺罪起訴，當被告行為構成下列要件時，檢察官常會以二級謀殺起訴酒駕致死：
１、 被告曾有過酒駕犯法的紀錄 且
２、 被告因酒駕違法，曾接受酒駕防制訓練課程並明確理解受Watson Admonition的告知（也就是酒駕的重大傷害、以及將有何種責任）
四、酒駕刑度在美國一向很高
１、以加州為例，一般酒駕致死最高刑度為１０年有期徒刑 （量刑由４到１０年不等，有無酒駕前科攸關量刑重大）
２、若構成二級謀殺之酒駕致死，則刑度可以高到１５年甚至無期徒刑
