三、專責小組須檢討校監委任校務委員的制度；及
四、專責小組須在檢討時充份諮詢大學各持份者。

【致港大校委會全體成員的公開信｜An Open Letter to all Members of the HKU Council】

致港大校委會全體成員：

港大校委會於一月例會中，決定待教資會公開《香港教資會資助高等教育院校的管治》報告後，成立專責小組，研究大學管治架構。該報告已於上月底公佈，五年一檢的限期亦早已屆滿，檢討大學管治實在刻不容緩。有見及此，我們敦促校委會必須於明天的會議中詳細討論專責小組的職權範圍和檢討事項，確保大學管治變革得以有效推行。

行政長官作為必然校監是眾多大學管治問題之根源。歷任港督深明院校自主之可貴，故均能自我約束權力，而擔任大學校監僅屬禮儀性質。然而，狼英政權過去一年恣意干預院校自主和學術自由，可見制度之弊端。專責小組必須正視問題，重新檢視校監產生辦法及其權力範圍。

此外，現時校外人士佔校委會大多數，唯校外人士大多為梁匪直接或間接委任之親信爪牙，致使種種外來政治打壓能干預人事任命。相反，校內人士勢孤力弱，其意見被視如敝屣糞土，難以反映院校利益，我校自主岌岌可危。專責小組必須檢視校委產生辦法，使校委會行使職權時在學術自由和向公眾問責中取得平衡。

學生作為大學的重要一員，其意見尤關重要；而我校一眾教職員，為其學術研究環境發聲亦是理所當然。因此，專責小組必須廣泛諮詢各持分者，確保其意見得以充分反映，在參考專業意見制定改革方針時，仍須捍衛院校理念和核心價值。

Members of the Council of the University of Hong Kong,

The HKU Council came to an agreement in the January Council Meeting to set up a review panel (“the Review Panel”) to study the structure of university governance after the release of the report on “UGC’s review of the Governance of Universities in Hong Kong”. Whereas the report had been published at the end of last month, and the deadline for a regular review in five-year had past long time ago, the review on university governance shall be conducted immediately without further delay . Thus, we urge the Council to discuss in details the Terms of Reference and the scope of review for the Review Panel to ensure reform on university governance could be carried out effectively.

The Chief Executive, being the ex-officio Chancellor of the University, is said to be the root cause of many problems in university governance . The past Governors understood well the commendableness of institutional autonomy and was self-disciplined enough to take the role of Chancellor on its honorary nature only. However, CY Leung’s arbitrary interference in our institutional autonomy and academic freedom have revealed the flaws of the mechanism. Hence, the Review Panel shall address the problem by looking into the mechanism for selecting the Chancellor and the scope of his power.

Apart from that, lay members are the majority in the Council now. Yet, they are CY Leung’s trusted subordinates and are mostly appointed directly or indirectly by him, resulting in various political suppressions that intervene with appointments of personnels. On the contrary, University members, who are at the weaker side, could hardly reflect the institution's interests as their views are often being neglected. Our autonomy is on the brink of collapse and the Review Panel shall review the selection method of Council Members. Only by doing that can the Council strike a balance between upholding academic freedom and public accountability when performing its duties.

Being the most important members of the University, students’ views shall not be ignored and shall be treated with respect and be taken into account. It is also reasonable for our academic staff to speak up and to pursue a better environment for conducting academic research. Therefore, the Review Panel shall widely consult different stakeholders to ensure a complete coverage of different opinions and to safeguard the vision and core values of the University while considering experts’ recommendations in formulating reform directions.

Arthur Li once said the decision on the scope of review lies with the Council Members. Thus, no Council Members could be excused from the matter when discussing the Terms of Reference and consultation methods. It is totally unacceptable for any Council Members to just vaguely say the review covers “any areas that affect the effectiveness of university governance. Holding an office, one needs to consider any matter concerned therewith. Every Council Member bears huge responsibility and holds the power to determine the destiny of the University.It is a matter of great importance and every Council member should take every possible steps they can to protect the integrity and the century-long reputation of our University. Any act that tries to ruin such reputation is absolutely intolerable. We therefore demand the Council Members to discuss the following issues and to announce discussion details and results after the meeting:

The Review Panel must review the status of Chief Executive as ex-officio Chancellor
The Review Panel must review the ratio of lay members to University members in the Council
The Review Panel must review the system of appointing Council Members by the Chancellor
The Review Panel must conduct comprehensive consultation of the review with stakeholders in the University
