FAQ ON DOMESTIC VIOLENCE : @lawchamberssailaja 1. WHAT IS DOMESTIC VIOLENCE? Domestic Violence (DV) is not limited to physical abuse but also includes emotional abuse, economical abuse, sexual abuse & psychological abuse. . 2. WHOM DOES DOMESTIC VIOLENCE ACT PROTECTS? Protects spouses, children, family members & incapacitated adults living as members of fam. . 3. WHAT ARE THE APPLICABLE LAWS? Domestic Violence is governed by Domestic Violence Act which defines DV & provides protection orders, is read together with Malaysian Penal Code. . 4. LODGE POLICE REPORT? YES!! . 5. WHAT IS Emergency Protection Order (EPO), Interim Protection Order (IPO) & Protection Order (PO) - are orders to prohibit the offender from using domestic violence against victim. . EPO is issued by social welfare dept (JKM), can be obtained immediately within 2 hours & valid for 7 days pending IPO or PO. Application can be made by the victim/victim’s lawyer at nearest JKM. . IPO is issued by Magistrate Court & valid throughout police investigation b4 the case is charged at court. You/your lawyer can inform the police when you lodge report for DV, that you want an IPO, get referral letter from police & apply at nearest JKM. Welfare officer will accompany you to court to apply for IPO. . PO is issued by Magistrate Court & is valid for 12 months & may be renewed. JKM officer will accompany you to court to apply for PO once the offender has been charged in court for domestic violence. . 6. PUNISHMENT FOR DOMESTIC VIOLENCE? If perpetrator violates an EPO, IPO or PO, he/she may be fined not exceeding 2k or imprisoned not more than 6 months or both. If perpetrator violates EPO, IPO or PO with violence, he/she may be fined up to 4k or imprisoned for 1 year or both. Repeated breaches by using violence will result in imprisonment of not less than 72 hours & not more than 2 years & fine not exceeding 5k. Police can arrest, without warrant, a perpetrator for violating IPO or PO. . 7. ARE MEN VICTIMS OF DOMESTIC VIOLENCE? YES! Men can be victims of domestic abuse. The City God (城隍) is an important system of belief in Taoism, and it is believed that the deity will protect the people of his city, town or village. These pictures were taken from the City God Temple in Pingyao County, the original temple was built during the Song dynasty and had fallen victim to fire over the years, the current temple is rebuilt in 1864.
